March 25, 2026 : The Allahabad High Court has granted anticipatory bail to Swami Avimukteshwaranand and Swami Pratyakchaitanya Mukundanand Giri in connection with a case registered under the POCSO Act, providing them protection from arrest.
The order was passed by a single-judge bench of Justice Jitendra Kumar Sinha, which considered the submissions made by both the defence and the prosecution. The Court observed that custodial interrogation was not required at this stage of the investigation, thereby justifying the grant of anticipatory bail.
Swami Avimukteshwaranand had approached the Court seeking relief, contending that the allegations against him were false and politically motivated. His counsel argued that he had been wrongly implicated, while the prosecution maintained that the investigation needed to proceed.
While granting relief, the Court directed that in the event of arrest, the accused shall be released on bail subject to standard conditions. These include cooperation with the ongoing investigation, appearance before authorities as required, and a strict prohibition on influencing witnesses or tampering with evidence.
The case has attracted public attention due to the religious leader’s prominence and the seriousness of the allegations. The Court’s order reiterates the settled legal principle that anticipatory bail acts as a safeguard against unnecessary arrest where immediate custodial interrogation is not essential.
The matter will now continue in accordance with law as further proceedings unfold.
