  • Justice Manmohan Highlights Enduring Impact of Kesavananda Bharati Verdict

    Supreme Court Justice Manmohan said that the landmark Kesavananda Bharati judgment played a critical role in securing the long-term strength of India’s Constitution. He noted that the ruling introduced the basic structure doctrine, which acts as a constitutional safeguard by allowing Parliament to amend the Constitution without altering its core character.

    Justice Manmohan explained that the judgment achieved a balance between flexibility and stability. It allowed the Constitution to evolve with the nation’s needs while preventing any attempt to dilute foundational principles, including democracy, judicial independence, federalism, and fundamental rights. He said the doctrine has served as a shield in times of political strain, ensuring that no authority can weaken the Constitution through amendments.

    He added that the Kesavananda Bharati ruling is now globally acknowledged as a landmark in constitutional law and as an example of India’s leadership in preserving democratic frameworks.
