  • Supreme Court Orders SIT Probe into Gurugram Child Rape Case, Flags Serious Lapses by Haryana Police

    March 25, 2026 : The Supreme Court of India on Wednesday expressed serious concern over the manner in which the Haryana Police handled the investigation of a rape case involving a four-year-old child in Gurugram, pointing to significant irregularities and a lack of sensitivity. The Court directed the constitution of a Special Investigation Team (SIT) to take over the probe and ensure a fair and thorough inquiry.

    The matter reached the Court after the victim’s family raised objections, alleging that the investigation was not conducted with due diligence and that the authorities failed to pursue the case with the seriousness it warranted.

    A Bench comprising Chief Justice of India Justice Surya Kant, Justice Joymalya Bagchi, and Justice N. Kotiswar Singh made strong observations regarding the conduct of the police. The Court indicated that there appeared to be attempts to dilute the case against the accused, including failure to invoke appropriate legal provisions in light of the gravity of the allegations.

    The Bench noted a troubling pattern in the investigation, suggesting that the approach adopted by the police raised doubts about whether efforts were made to shield the accused rather than secure justice. Such lapses, the Court observed, undermined the credibility of the probe.

    The Court also took serious note of how the child victim was treated during the investigation. It found that procedural handling caused additional distress to the minor, effectively leading to re-traumatisation. The judges emphasised that cases involving children require heightened sensitivity and strict adherence to safeguards designed to protect victims from further harm.

    Concerns were further raised regarding procedural lapses, particularly in the recording of the victim’s statement and compliance with established legal protocols for child victims. The Court reiterated that such safeguards are not optional and must be followed rigorously.

    Underscoring the role of the judiciary, the Bench clarified that the determination of the nature and severity of an offence rests with the courts, not the investigating authorities. Any attempt to dilute charges at the initial stage, it observed, compromises the integrity of the justice process.

    In view of these findings, the Court transferred the investigation to an SIT to restore confidence in the process and ensure accountability for any lapses. The case highlights the critical importance of fairness, procedural compliance, and sensitivity in handling crimes against children, and reflects the Court’s readiness to intervene where investigative failures threaten justice.
