Supreme Court Stays Calcutta High Court Order Disqualifying Mukul Roy as West Bengal MLA

January 16 , 2026 : The Supreme Court of India on Friday stayed a judgment of the Calcutta High Court that had disqualified veteran leader Mukul Roy from the West Bengal Legislative Assembly for switching parties.

A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi issued notice and stayed the high court ruling while hearing a petition filed by Roy’s son, Subhranshu Roy, challenging the disqualification.

The high court had held that Mukul Roy, who was elected from Krishnanagar Uttar on a Bharatiya Janata Party ticket in the 2021 Assembly elections, attracted disqualification under the anti-defection law after joining the ruling Trinamool Congress. The court had also set aside his appointment as chairman of the Public Accounts Committee.
