  • High Court of Chhattisgarh Issues Fresh Practice Directions to Speed Up Execution Cases Across State

    February 26, 2026 : In a significant move aimed at reducing delays in execution proceedings, the High Court of Chhattisgarh has issued new Practice Directions to all District Judiciary courts across the state. The directive, released from Bilaspur on February 26, 2026, mandates strict compliance to ensure the effective and time-bound disposal of pending execution petitions.

    The directions have been issued in compliance with an order of the Supreme Court of India dated October 16, 2025, in Miscellaneous Application Nos. 1889-1891/2025 arising out of Civil Appeal Nos. 3640-3642/2025 in the matter titled Periyammal (Dead Thr. Lrs.) & Ors. Vs. V Rajamani & Anr..

    Under the new directions, all courts have been instructed to treat execution proceedings as priority matters. The High Court emphasized that decree-holders are entitled to timely realization of their legal rights and that execution cases must not be allowed to linger unnecessarily.

    All pending execution cases must be identified and physically verified. Fresh execution petitions are to be disposed of within six months from the date of filing, in strict adherence to earlier circulars issued by the High Court.

    To ensure accountability, Principal District Judges are required to conduct monthly reviews of execution case pendency and progress. They must also obtain monthly reports from District Nazir or Naib Nazir offices regarding warrants of attachment and possession issued and ensure efforts to minimize non-compliance.

    Specialized training programs will be organized for court staff, including those in the Nazir branch, bailiffs, and process servers. The training will focus on procedural efficiency, prompt service of notices, property attachment and auction procedures, coordination with police and revenue authorities, and effective use of digital platforms such as CIS and NJDG.

    The Practice Directions call for prompt issuance and diligent follow-up of warrants of attachment, sale, or arrest. Objections under Section 47 of the Civil Procedure Code and other interlocutory applications must be disposed of expeditiously. Courts have also been instructed to firmly deal with frivolous or dilatory tactics adopted by judgment-debtors.

    The High Court has encouraged the use of video conferencing where appropriate and emphasized optimal utilization of digital case information systems to enhance transparency and monitoring.

    Principal District Judges must submit compliance reports within one month of the issuance of the Practice Directions.

    The order was issued by Registrar General Shri Rajnish Shrivastava by direction of the High Court at Bilaspur, reinforcing the judiciary’s commitment to expeditious justice delivery across Chhattisgarh.
