April 16, 2026 : The Supreme Court of India has declined to directly examine a petition raising concerns over the sale of liquor in tetra pack packaging in Uttar Pradesh, allowing the petitioner to seek relief before the appropriate state authority instead.
A Bench headed by Chief Justice of India Justice Surya Kant, along with Justice Joymalya Bagchi and Justice Vipul M. Pancholi, observed that it would not be appropriate to adjudicate the issue without a clear understanding of the applicable excise policy. The Court noted that the petitioner had failed to place the complete policy framework on record, making it difficult to determine whether such packaging was officially permitted.
During the hearing, the petitioner argued that selling liquor in tetra packs could have broader social consequences, particularly because such packaging resembles common beverage cartons. It was contended that this could increase the risk of exposure among children and make alcohol more easily accessible.
The Bench, however, found these concerns unsubstantiated in the absence of empirical material. It remarked that the format of packaging, by itself, does not necessarily influence consumption patterns. The Court also questioned whether there was any concrete evidence linking tetra pack packaging to adverse effects, especially among minors.
In view of the lack of supporting data and policy clarity, the Court declined to examine the matter on merits. It granted liberty to the petitioner to submit a representation before the competent authority in Uttar Pradesh, which may consider the issue in accordance with law.
The plea was accordingly disposed of, leaving the issue open for administrative consideration rather than judicial intervention at this stage.
