Supreme Court Permits Newly Qualified AORs to Vote in SC AOR Association Elections, Bars Them from Contesting

April 27, 2026 : The Supreme Court of India has granted interim relief allowing recently qualified Advocates-on-Record (AORs) to vote in the upcoming elections of the Supreme Court Advocates-on-Record Association, addressing concerns over their exclusion from the electoral roll.

The direction came while hearing a petition challenging the voters’ list, which had omitted several newly registered AORs. The Court held that those who had completed all registration formalities by mid-April would be entitled to vote in the present elections. However, it clarified that these members would not be eligible to contest.

The dispute arose due to administrative delays that prevented timely inclusion of eligible AORs, despite them having fulfilled all substantive requirements. Petitioners contended that excluding them from voting created an arbitrary distinction between similarly situated professionals.

Taking note of these concerns, the Court observed that procedural lapses should not override substantive rights. It emphasised that eligible members cannot be denied participation in the affairs of their professional body merely due to administrative inefficiencies.

The ruling is likely to expand voter participation in the upcoming elections and may lead to a reassessment of existing timelines and procedures to ensure fairer and more inclusive representation within the association.
