Supreme Court Says Authorities Must Show Restraint While Dealing with Student Protesters, Violence Will Only Worsen Situation

August 5, 2026 : The Supreme Court has observed that authorities must exercise restraint while responding to student protesters, emphasizing that the use of violence to curb protests can only escalate tensions instead of restoring peace.

A Bench headed by Chief Justice of India Justice Surya Kant made the observation while hearing a petition seeking action against the CJP over its alleged role in recent violence during student-led protests in Delhi and several other parts of the country. The petition alleges that protests witnessed incidents of stone pelting and other acts of violence.

During the hearing, the Chief Justice remarked that the most effective way to deal with such situations is to understand the concerns of young protesters rather than respond with force. The Bench observed that authorities should first listen to what the students are saying and identify the reasons behind their agitation before taking any action.

The Supreme Court also decided to tag the matter with other pending petitions relating to violence during student protests in Delhi and various States so that all connected issues can be heard together.

Expressing confidence in law enforcement agencies, the Court observed that the authorities are better equipped to assess the ground situation and take appropriate action in accordance with the law. It said the matter should be left to the wisdom of the investigating and enforcement agencies.

The Bench further stated that it would consider the issue on the next date of hearing after taking note of the Central Government’s response in the matter.
