  • RERA Raipur Orders Developer to Provide Basic Amenities in Adarsh Green Phase-01 Project Within 45 Days

    March 23, 2026 : In a significant ruling, the Real Estate Regulatory Authority (RERA), Raipur has directed a developer to ensure the provision of essential civic amenities in a residential project after finding deficiencies in basic infrastructure and services promised to buyers.

    The order, dated March 23, 2026, was passed in a complaint filed by a homebuyer against the developer of “Adarsh Green Phase-01” located in Raipur. The complainant had alleged that despite purchasing a plot in August 2021 and beginning construction in 2022, several promised facilities were either incomplete or not provided at all.

    According to the complaint, the developer had assured key amenities such as proper drainage, street lighting, electricity connections, drinking water supply, parks, security, and other infrastructure. However, the buyer claimed that these facilities were either partially developed or completely absent, causing serious inconvenience to residents.

    The complainant also alleged irregularities in maintenance charges and payments made towards electricity connections, stating that amounts were collected without proper receipts. Additionally, it was claimed that water supply was abruptly stopped in November 2025 without prior notice, forcing residents to rely on water tankers and incur additional expenses.

    The developer, on the other hand, denied the allegations and argued that the complaint was based on incorrect and misleading facts. It was submitted that the project was still under development and had been granted time until May 2026 for completion. The developer further contended that maintenance charges were payable by residents and that non-payment had led to disruptions in services like electricity.

    After examining the submissions and documents on record, RERA held that certain basic amenities such as drinking water, street lighting, and external electrification infrastructure fall within the developer’s responsibility and cannot be denied to residents.

    The Authority clarified that while individual electricity meters are to be obtained directly from the electricity distribution company by buyers, the developer is obligated to ensure necessary infrastructure for such connections.

    In its final directions, RERA ordered the developer to complete and provide essential services within 45 days. These include installation of external electrification infrastructure, provision of street lighting across the colony, and ensuring availability of adequate drinking and domestic water supply.

    However, the Authority declined to grant compensation to the complainant, observing that no concrete evidence of specific financial loss or damage had been established.

    The ruling reinforces the principle that developers must deliver basic infrastructure and services promised under real estate projects and cannot withhold essential amenities citing disputes over maintenance charges.
