Supreme Court Dismisses PIL Seeking “National Son” Status for Subhas Chandra Bose, Warns Against Repetitive Petitions

April 20, 2026 : The Supreme Court on Monday dismissed a public interest litigation that sought to declare Subhas Chandra Bose as India’s “National Son” and to officially recognise the Indian National Army (INA) as the force that secured the country’s independence. The Court also cautioned the petitioner against filing similar pleas again.

A Bench led by Chief Justice of India Surya Kant, along with Justice Joymalya Bagchi, noted that identical issues had already been raised and rejected earlier. The judges made it clear that the Court would not entertain repeated petitions on matters that stand settled.

During the hearing, the Bench expressed concern over the growing trend of repetitive litigation under the guise of public interest. It warned the petitioner that continuing to file such pleas could lead to stricter measures, including possible restrictions on approaching the Court. The judges also indicated that the Registry may be directed to refuse acceptance of further petitions from him on the same issue.

The plea had sought multiple declarations, including formal recognition of Bose as the “National Son,” official acknowledgment of the INA’s role in India’s independence struggle, and designation of certain dates associated with Bose and the INA as national observances. The Court, however, held that such issues fall within the domain of the executive and legislature, not the judiciary.

With this order, the Supreme Court reiterated that the PIL mechanism cannot be used to repeatedly raise settled questions, stressing that such misuse undermines the purpose of public interest litigation.
