  • Supreme Court Refers Isha Foundation Crematorium Dispute to Mediation

    February 26, 2026 : The Supreme Court has referred to mediation an ongoing dispute between the Isha Foundation and residents of a village in Coimbatore over the operation of a crematorium near a residential area.

    A bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and Vipul M. Pancholi, noted that the Foundation is engaged in charitable and socially beneficial work, describing its activities as pious in nature. At the same time, the Court recognised the concerns raised by local residents, who alleged that the crematorium’s functioning has caused inconvenience and environmental discomfort in the vicinity of their homes.

    The residents had earlier approached the Madras High Court, challenging the legality of the crematorium on the ground that local regulations prescribe a minimum distance between burial or burning grounds and residential areas. After the High Court declined to grant relief, the matter was brought before the Supreme Court.

    In an effort to arrive at a balanced solution, the apex court directed the parties to explore an amicable settlement through mediation. A retired Supreme Court judge has been appointed to facilitate discussions between the Foundation and the affected residents. The Court indicated that potential solutions could include relocation or compensation, if required, to address the grievances of the villagers.

    By opting for mediation, the Supreme Court underscored the importance of dialogue in resolving disputes involving community concerns, while ensuring that developmental activities and residents’ rights are both given due consideration.
