April 2, 2026 : In a significant judgment protecting the rights of retired government employees, the High Court of Chhattisgarh has quashed a recovery order aimed at a former Assistant Professor, calling the state’s actions “manifestly driven by mere whims and fancies”. The court ordered the immediate release of ₹6,75,288 in withheld gratuity, emphasizing that the government cannot bypass statutory limitations to penalize pensioners for decades-old administrative lapses.
The case centered on Sylverius Barwa, who retired on June 30, 2021, after serving at Government Mahaprabhu Vallabhacharya Postgraduate College in Mahasamund. Following his superannuation, the Higher Education Department attempted to recover over six lakh rupees from his gratuity, alleging he was responsible for 12,368 “missing” library books valued at approximately ₹13.5 million. The state claimed the loss occurred during Barwa’s tenure as the Incharge Librarian starting back in 1996.
However, Justice Amitendra Kishore Prasad found the state’s premise fundamentally flawed. The court noted that the so-called “missing” books were never actually lost; they had been stored in a locked room due to a failure in formal handover procedures between various staff members over an 11-year period. The books were eventually located and verified in January 2022, yet the state persisted with the financial recovery against the retired professor.
Legally, the court ruled that the recovery violated Rule 9 of the Civil Services (Pension) Rules, 1976. This rule strictly prohibits the initiation of departmental proceedings against a pensioner for events that occurred more than four years prior to the inquiry. Since the allegations dated back to 2010 and 2011, the court deemed the state’s 2022 recovery order “legally unsustainable” and barred by limitation.
Justice Prasad criticized the authorities for dragging a senior citizen into “unavoidable litigation” twice to claim life savings that were protected by law. The judgment directs the State of Chhattisgarh to refund any recovered amount within 45 days, along with 6% annual interest.
