Bilaspur, Chhattisgarh : The Takhatpur Court had sentenced teacher Vivek Gupta on September 26, 2026, convicting him on charges of harassment and assault of a female teacher. Even 24 days after the sentencing, no departmental action has been taken against him, and he continued to serve at a government school.

The convicted teacher, Vivek Gupta, is posted at the Belmundi school. Even after the court’s verdict, information has surfaced that the teacher continued to report to school regularly. According to the school’s head teacher, Sanjay Kumar Vishwakarma, the teacher was present at the school on October 16 as well. The head teacher said that the teacher had not informed him about the sentence handed down by the court.

On the other hand, District Education Officer Sandeep Pandey said he was not aware of the sentence. He stated that he would ascertain the status of the court order and take action on a priority basis.

According to the prosecution, the incident took place on February 17, 2018, at the Government Primary School Chanadongri. The female teacher posted there had alleged that Vivek Gupta grabbed her hand and pulled her, and touched her chest. When she resisted, he made derogatory remarks about her character and assaulted her, pushing her toward a wall, which caused injuries to her face and head. The case also included allegations of throwing acid and threatening to kill her.

The court of Judicial Magistrate First Class Richa Yadav sentenced Vivek Gupta to one year of rigorous imprisonment and a fine of Rs 1,000 under Section 354 of the Indian Penal Code. A fine of Rs 1,000 was also imposed under Section 323. It was stated that if the fine is not paid, an additional rigorous imprisonment of one month for each section would be served.

After considering the victim’s testimony, statements of other witnesses, and medical evidence, the court found the charges of harassment and assault proven. However, he was acquitted of the charges of stalking, obscene abuse, and criminal intimidation, giving him the benefit of the doubt due to insufficient evidence. The court also directed that the period spent in judicial custody from August 7 to October 9, 2018, be set off against the sentence.

When a government employee is convicted in a criminal case, departmental action should be taken under the relevant service rules. Under Rule 19 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966, action can be taken according to the prescribed procedure on the basis of conviction.
