Allahabad High Court Orders FIR Against Rahul Gandhi in Dual Citizenship Case

April 17, 2026 : The Allahabad High Court’s Lucknow Bench on Saturday directed the registration of a First Information Report (FIR) against Rahul Gandhi, Congress MP from Rae Bareli and Leader of the Opposition in the Lok Sabha, in connection with allegations relating to dual citizenship.

A single-judge Bench of Justice Subhash Vidhyarthi observed that the allegations raised against Gandhi warranted examination at the investigative stage. The Court accordingly directed the Uttar Pradesh government to either undertake the investigation itself or transfer the matter to an appropriate central agency.

The order was passed on a petition filed by BJP worker S. Vignesh Shishir, who had challenged a January 28 decision of a special MP/MLA court in Lucknow. The lower court had refused to order registration of an FIR, holding that questions concerning citizenship fall outside its jurisdiction.

The complaint was originally filed before a special MP/MLA court in Rae Bareli. The High Court had earlier transferred the matter to Lucknow on December 17 last year. After the Lucknow court declined relief, the petitioner moved the High Court seeking intervention.

With the present direction, the High Court has paved the way for a formal investigation into the allegations, leaving it to the state authorities to determine the appropriate course of action regarding the probe.
