Allahabad High Court Orders FIR Against Rahul Gandhi in Dual Citizenship Case

April 18, 2026 : The Allahabad High Court (Lucknow Bench) has directed the registration of a First Information Report (FIR) against Congress MP Rahul Gandhi in connection with a dual citizenship allegation. Justice Subhash Vidyarthi, in an order passed yesterday, held that the claims raised against the Leader of the Opposition in the Lok Sabha warrant proper examination. The court directed the Uttar Pradesh government to either investigate the matter itself or refer it to a central agency.

The order came on a petition filed by BJP worker S. Vignesh Shishir, who challenged a January 28 decision of a special MP/MLA court in Lucknow. That court had refused to order an FIR, observing that it lacked jurisdiction to adjudicate issues relating to citizenship.

The complaint was originally filed before a special MP/MLA court in Rae Bareli. The High Court had transferred the case to Lucknow on December 17 last year. After the Lucknow court dismissed his plea, the petitioner moved the High Court, which has now directed that an FIR be registered for further investigation.
