Supreme Court Seeks Draft Rules Under Bharatiya Vayuyan Adhiniyam, 2024 in Sealed Cover

July 13, 2026 : The Supreme Court on Tuesday directed the Central Government to place on record, within two weeks, the draft rules framed under the Bharatiya Vayuyan Adhiniyam, 2024, which aims to modernise India’s civil aviation regulatory framework.

A Bench comprising Justice Vikram Nath and Justice Sandeep Mehta, while hearing a public interest litigation (PIL), instructed the Centre to submit the draft rules in a sealed cover, irrespective of whether they have been laid before Parliament.

Appearing for the Centre, counsel informed the Court that the draft rules have already been prepared and are currently undergoing translation. The counsel further submitted that the rules are required to be placed before Parliament before they are formally notified.

Taking note of the submission, the Supreme Court listed the matter for further hearing on August 3.

The PIL seeks the establishment of a robust and independent civil aviation regulator to ensure greater transparency, accountability, and protection of passengers’ rights across the aviation sector. It also seeks the formulation of regulatory guidelines to curb unpredictable fluctuations in airfares and ancillary charges imposed by private airlines operating in India.

Earlier, the Central Government had informed the Supreme Court that the Ministry of Civil Aviation was actively examining the concerns raised in the petition and considering appropriate measures to address them.
