The Supreme Court on Wednesday underscored the operational challenges investigators face in an era dominated by digital evidence, observing that issuing prior notice before conducting a search and seizure could derail an investigation at the outset.
The Court was hearing a public interest litigation that questioned the breadth of powers under Section 132 of the Income Tax Act, arguing that the provision is susceptible to misuse by authorities.
A Bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi noted that advance intimation may frustrate the very objective of a search operation, particularly in cases involving electronic records. The Bench observed that digital evidence can be swiftly altered, concealed, or destroyed, making surprise an essential element of effective investigation.
