    March 26, 2026 : A panel appointed by the Supreme Court of India has recommended that the central government withdraw the proposed Transgender Amendment Bill, citing serious concerns over its potential impact on the rights and dignity of transgender persons.

    The committee, chaired by former judge Justice Asha Menon, has written to the Ministry of Social Justice and Empowerment highlighting multiple issues in the draft legislation. It has called for a thorough reconsideration, noting that several provisions could weaken, rather than strengthen, existing protections.

    According to the panel, the proposed amendments risk diluting key safeguards rooted in principles of equality, autonomy, and self-identification. A major concern is the apparent expansion of bureaucratic oversight in gender recognition processes, which could make it more difficult for individuals to assert their identity without undergoing intrusive procedures.

    The panel also observed that the bill falls short of reflecting earlier judicial directions that emphasized respect for self-identification and non-discrimination. Instead of advancing inclusion, it may create fresh hurdles for transgender individuals in accessing education, employment, healthcare, and welfare schemes.

    Emphasizing participatory policymaking, the committee stressed the need for meaningful consultation with the transgender community before introducing any legislative changes. It noted that policies affecting marginalized groups must be informed by their lived realities to ensure both fairness and effectiveness.

    In its recommendations, the panel urged the government to adopt a more rights-based and inclusive approach by revisiting the draft, engaging in wider dialogue, and aligning the law with constitutional principles and international human rights standards.

    The development has reignited debate around transgender rights, with activists and advocacy groups echoing the panel’s concerns. They maintain that any legal framework governing transgender persons must prioritize dignity, autonomy, and equal opportunity.
